1. Who We Are

MixerDash ("MixerDash", "we", "us", or "our") provides a web-based product that may include dashboards, integrations, and related features. References to "you" or "your" mean the individual or entity using the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

3. Account Registration & Security

• You may need an account to use some features.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to notify us promptly of any unauthorized access or use of your account.

If you sign in using Google OAuth, your use is also governed by our Privacy Policy.

4. Use of the Service

You agree not to misuse the Service. For example, you must not:

• Attempt to interfere with or disrupt the Service, servers, or networks.
• Probe, scan, or test the vulnerability of any system or bypass security measures.

Some features may require payment. If you purchase a paid plan:

• Prices, billing cycles, and included features will be shown at checkout or within the Service.
• Fees are generally non-refundable except where required by law or explicitly stated otherwise.
• We may change pricing or plan features with reasonable notice.

10. Availability, Changes, and Suspension

We may modify, suspend, or discontinue the Service (in whole or in part) at any time, including to maintain, improve, or comply with legal requirements.

You may stop using the Service at any time. We may terminate or suspend access as described above.

Sections that by their nature should survive termination will survive, including (but not limited to) intellectual property, disclaimers, limitation of liability, and dispute terms.

12. Disclaimer

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

13. Limitation of Liability

To the maximum extent permitted by law, MixerDash will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the amount you paid to us for the Service in the 12 months prior to the event giving rise to the claim (or AUD $100 if you have not paid anything).

14. Indemnity

You agree to indemnify and hold harmless MixerDash from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service,
• Your Content,
• Your violation of these Terms, or
• Your violation of any rights of another person or entity.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.

You agree that courts located in New South Wales, Australia will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where prohibited by law.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Service after changes become effective means you accept the updated Terms.
